5.1 How does LingoHub protect personal information?
LingoHub takes technical and organizational measures to ensure that personal information is processed securely and protected against unauthorized or unlawful processing, accidental loss, destruction, or damage. We use verified service providers and contractors with whom we have signed Data Processing Agreements, and we ensure that Personal Data is encrypted and anonymized where appropriate.
LingoHub has achieved SOC 2 Type 2 certification, an internationally recognized standard that confirms we maintain strong system and organization controls for the security, availability, and confidentiality of Customer Data. This certification demonstrates our ongoing commitment to safeguarding User information and operating in accordance with industry-leading security practices. We also use Amazon Web Services (AWS) data centers that are certified under ISO 27001 and SOC 1, SOC 2, and SOC 3 (SSAE 18) standards to host and process data.
While we apply rigorous technical and organizational measures, no method of transmission or electronic storage is entirely secure. Therefore, we cannot guarantee absolute security. If we learn of a security incident that affects your Personal Data, we will take prompt steps to investigate, mitigate the impact, and, where required, notify you and the relevant authorities without undue delay, in accordance with applicable data protection laws.
5.2 What is personal information, and what is processing personal information?
Personal Data or personal information is any information relating to you and that alone or in cumulation with other pieces of information, gives the opportunity to the person that collects and processes such information to identify you as a person. It can be your name, your identification number, your location data, or information related to your physical, physiological, genetic, mental, economic, cultural, or social life. Processing of the information means any action with your Personal Data, for example, collection, recording, organization, structuring, storage, use, disclosure by any means, and so on.
5.3 Who will get access to your personal information?
In order to provide high-quality services within the LingoHub Platform and/or Services, LingoHub hires people, enters agreements with independent contractors as well as cooperates with other service providers, companies, and organizations. For that reason, some of your personal information can be passed to the persons mentioned. For example, LingoHub uses Amazon Web Services as well as services and products of Google Inc. to store and process information needed to provide services. LingoHub also strives to make it comfortable for you to use your accounts in other products and services in order to manage your LingoHub account. For example, the data can be passed from your account at github.com, play.google.com, and so on. If this is done, the rules for processing and transferring data set by the relevant services you run an account at apply.
In order to achieve the Service goals in the best way, LingoHub uses various technologies and services, including the ones provided and/or hosted in the EU, US, and other countries. Some of them guarantee a very high level of Personal Data protection, and in some of them, the level of protection is lower. By registering with the Service and by using it, you agree to such transfer and processing within the purposes set in Section 4 of this Privacy Policy.
LingoHub has entered into Data Processing Agreements (DPAs) with all sub-processors that handle personal information on our behalf to ensure GDPR-compliant processing. Please access our List of Sub-Processors for more details.
In all cases where we pass the information to other persons, we ensure that your information is being protected and used only within the purposes specified in Section 4 of this Privacy Policy. This is achieved by using only certified services and products, signing agreements on protection of Personal Data with contractors as well as taking technical measures to ensure the information is protected when stored, used, and while being transferred.
You also have to be aware that LingoHub may disclose your personal information to enforce and comply with the law. In other words, LingoHub may disclose to officials information necessary for the investigation or legal process on official request or the official bodies acting within their powers.
5.4 How long will the personal information be processed and stored by LingoHub?
LingoHub retains personal information only as long as necessary to operate and provide the LingoHub Platform and/or Services, maintain your account, and meet our legal obligations. Personal Data is stored during an active contractual relationship between you and LingoHub. After an account is canceled or deleted, related Personal Data may remain in system backups for up to 90 days before automatic deletion. Specific technical and access logs are kept for up to 90 days for operational, diagnostic, and security reasons.
Once these retention periods expire, or once you request the erasure of your data, LingoHub permanently deletes or anonymizes the information unless a longer retention period is required by law (for example, for accounting or tax purposes).
5.5 How does LingoHub act as a data controller or data processor?
Data protection law in certain jurisdictions (e.g., the GDPR) differentiates between the “controller” and “processor” of Personal Data.
If you are an authorized User of our Customer, or if you are our Customer yourself, please note that you are deemed the controller of all Personal Data that you or your authorized Users transfer to LingoHub in connection with the use of the Platform and/or Services. We only process such Personal Data on behalf of our Customer as a processor. Therefore, requests on such Personal Data should initially be submitted directly to our Customer.
Otherwise (for example, if you are a visitor to our website who has not signed up to the LingoHub Platform), we are deemed the controller of your Personal Data. Thus, you have the right to address your requests regarding the processing of Personal Data to us.
Insofar as we are the controller of Personal Data, please see section 10 for contact information.
6. Your rights regarding your personal information
You have specific rights under data protection law regarding the personal information we process. This section outlines those rights and how you can exercise them. If you are a LingoHub User, you can manage many of your settings directly within your User Account.
6.1 You have a right to request LingoHub to give you access to your personal information
That means that you can ask LingoHub what personal information of yours is being processed, as well as for the clarifications on the information described above, i.e. purpose of collecting and processing, period of processing, and third parties that have access to information.
6.2 You have a right to request LingoHub to rectify your personal information
This means you can ask for all the inaccurate personal information concerning you to be corrected. You can also complete the personal information if you feel there is a need to do so.
6.3 You have a right to request LingoHub to erase personal information
You can request LingoHub to erase such data if its processing is no longer necessary in relation to the purposes for which it was collected as well as if there are no legal grounds for the processing. In most cases, LingoHub will erase it unless otherwise required by legislation.
6.4 You have a right to request LingoHub to restrict the processing of your personal information
In some cases, as prescribed by law, you will be able to restrict the processing of your Personal Data, for example, if you contest the accuracy of your personal information being processed or if LingoHub will not be interested in processing your personal information any longer, but you will want LingoHub to do this on different reasons, for example, to bring some claim for somebody and instead of the erasure of information its processing will be just restricted.
6.5 You have a right to withdraw consent
Where processing is based on your consent, you can withdraw that consent at any time, without affecting the lawfulness of processing carried out before the withdrawal. After we receive your withdrawal, we will work on it in a timely manner and stop processing your personal information for those purposes unless we have another lawful basis to continue. The phrase “in a timely manner” is deciphered below in 6.6.
6.6 Time for reply and reaction
LingoHub will provide information on action taken on your request related to your rights specified above within one month of receipt of the request for the longest. That period may be extended by two further months if LingoHub is overwhelmed by the number of requests. LingoHub will inform you of any such extension within one month of receipt of the request, together with the reasons for the delay. You also have the right to lodge a complaint with a competent supervisory authority. In Austria, this is the Österreichische Datenschutzbehörde, Barichgasse 40–42, 1030 Vienna, Austria.
A current list of National Data Protection Authorities, members of the European Data Protection Board, can be found here.
6.7 Right to object
You have the right to object at any time to the processing of your personal information when such processing is based on our legitimate interests in accordance with Article 6 (1) (f) GDPR. If you exercise this right, we will stop processing your personal information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or unless the processing is necessary for the establishment, exercise, or defense of legal claims. You also have the right to object at any time if your Personal Data is processed for direct marketing purposes.
6.8 Right to data portability
Where we process your Personal Data based on your consent or on a contract with you, and the processing is carried out by automated means, you have the right to receive the Personal Data you provided to us in a structured, commonly used, and machine-readable format and to transmit that data to another controller. Where technically feasible, you may also request that we transmit the data directly to another controller.
7. Consent and Services
By using this website, particularly by contacting LingoHub or other providers, the User gives their consent to the storage and processing of all Personal Data collected, including information gathered regarding content, usage, transmission, and connection. Should the User make use of the LingoHub Platform and/or Services in a way not in line with LingoHub Terms & Conditions, this Privacy Policy, or any other relevant legal document established between the User and LingoHub, LingoHub is entitled to use and pass on such data to third parties for the purpose of pursuing further legal action, ditto in compliance with court orders or orders made by or in the name of a public authority. The User is entitled to withdraw his/her consent at any time. Under no circumstances will LingoHub disclose data to third parties not specified here for advertising purposes.
7.1 Links to other sites
Our Service may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third-party’s site. We strongly advise you to review the Privacy Policy of every site you visit.
We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
7.2 Children’s privacy
Our Service does not address anyone under the age of 18 (“children”).
We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.
8. International Transfers and Legal Safeguards
LingoHub is a global business. Personal Data may be stored and processed in any country where we or our service providers operate. This may include transfers of your data to countries outside the European Economic Area (EEA), the United Kingdom (UK), Switzerland, and the United States. These countries may have data protection laws that differ from those in your country of residence.
Whenever we transfer Personal Data internationally, we take appropriate measures to ensure that such transfers comply with applicable data protection laws and that your information remains protected to the standards described in this Privacy Policy. In certain circumstances, courts, law enforcement agencies, regulatory bodies, or security authorities in those countries may be entitled to access your Personal Data.
To safeguard international transfers, LingoHub relies on one or more of the following legal mechanisms:
-
Standard Contractual Clauses (SCCs) approved by the European Commission;
-
Adequacy decisions issued by the European Commission or UK authorities, where available; and
-
the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce, where applicable to our U.S. service providers (including Amazon Web Services, Intercom, Mailgun, and Stripe).
These mechanisms ensure that your Personal Data continues to receive a level of protection essentially equivalent to that guaranteed within the EEA. You can request further details about the safeguards we apply to international transfers by contacting us at [email protected].
